These Terms of Service (“Terms”) govern your access to and use of the Pipeline Homes website, related landing pages and subdomains, downloadable materials, forms, communications, and other online services that link to these Terms (collectively, the “Site”).
The Site is owned or operated by Pipeline Homes, LLC, an Arizona limited liability company (“Pipeline Homes,” “we,” “us,” or “our”).
By accessing or using the Site, submitting information, downloading materials, or requesting that we contact you, you acknowledge that you have read and agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site.
1. Eligibility and Permitted Use
You must be at least 18 years old and legally capable of entering into a binding agreement to use the Site or submit information concerning real property.
You may use the Site only for lawful personal or business purposes relating to real estate information, consultation, property-sale options, or services offered by Pipeline Homes.
You may not:
Use the Site for fraudulent, unlawful, misleading, or abusive purposes.
Submit information about property you do not own or have authority to discuss.
Impersonate another person or misrepresent your identity, authority, or circumstances.
Attempt to gain unauthorized access to the Site, accounts, systems, or data.
Introduce malware, automated scraping tools, bots, or harmful code.
Copy, republish, sell, or exploit Site content without written authorization.
Use information obtained through the Site to harass, discriminate against, or unlawfully solicit another person.
Interfere with the Site’s operation or security.
We may restrict or terminate access to the Site when we reasonably believe these Terms have been violated.
2. About Pipeline Homes
Pipeline Homes provides information and potential solutions for homeowners considering the sale of real property. Depending on the circumstances, those solutions may include:
A potential purchase of property by Pipeline Homes, an affiliate, or another investor.
Traditional real estate brokerage or listing services.
Referral to another real estate or service professional.
General information about possible real estate options.
No transaction, when selling is not appropriate or the parties do not reach an agreement.
Submitting information or speaking with Pipeline Homes does not obligate you to sell your property, accept an offer, list your property, or enter into any transaction.
Pipeline Homes is not a lender, mortgage servicer, foreclosure trustee, government agency, law firm, tax adviser, credit-repair organization, or nonprofit housing-counseling agency. Pipeline Homes is not affiliated with your lender or with any federal, state, county, or local government agency.
3. Real Estate License and Investor Disclosure
Tim O’Riley is an Arizona-licensed real estate professional affiliated with West USA Realty and is also a real estate investor. Other persons associated with Pipeline Homes may also be investors, licensed real estate professionals, service providers, or transaction participants.
Pipeline Homes or its associated persons may potentially act in one of several capacities, including:
As a prospective buyer or investor acting for their own account.
As a licensed real estate professional providing brokerage services through the applicable brokerage.
As a source of general information.
As a referring party connecting you with another provider.
The applicable role will be identified before you enter into a transaction and may require separate written disclosures, agreements, agency forms, employment agreements, purchase contracts, or other documentation.
Your use of the Site does not create a broker-client, agent-client, fiduciary, advisory, attorney-client, or other professional relationship. A real estate agency or brokerage relationship is created only through an appropriate written agreement when required by law.
Any brokerage services performed by Tim O’Riley will be performed through West USA Realty and governed by the applicable brokerage documents and Arizona law.
4. Investor Offers and Potential Conflicts
When Pipeline Homes, an affiliate, or another investor makes or facilitates a purchase offer, the buyer may be acting solely as a principal for its own benefit and not as your agent or fiduciary.
An investor offer may be less than the price that might be obtained through a traditional market listing. The proposed buyer may consider anticipated repairs, holding costs, financing costs, resale expenses, market risks, and expected profit when establishing an offer.
A buyer may renovate, resell, rent, assign, wholesale, finance, or otherwise transfer or profit from the property, subject to the applicable contract and law.
You are encouraged to:
Compare a proposed investor offer with potential listing and other sale alternatives.
Review anticipated proceeds, expenses, commissions, repairs, timing, and risks.
Obtain independent legal, tax, financial, title, appraisal, inspection, or real estate advice.
Carefully review all transaction documents before signing.
No statement on the Site should be interpreted as a promise that one particular method of selling is best for every homeowner.
5. No Legal, Tax, Financial, or Foreclosure Advice
Information provided through the Site, downloadable guides, videos, emails, text messages, consultations, or other communications is for general educational and informational purposes.
It is not legal, tax, accounting, financial-planning, credit, bankruptcy, lending, appraisal, or foreclosure-prevention advice.
Foreclosure, probate, divorce, bankruptcy, liens, taxes, title, loan modifications, short sales, and inherited-property matters can involve significant legal and financial consequences. You should consult appropriately licensed professionals regarding your circumstances.
Pipeline Homes cannot guarantee that contacting us, requesting an offer, listing a property, or pursuing any particular option will stop, postpone, cancel, or otherwise affect a foreclosure, trustee’s sale, eviction, court deadline, tax sale, or lender action.
You remain responsible for monitoring and responding to all legal notices, contractual deadlines, court dates, lender communications, and governmental requirements.
6. No Guarantee of Results
Real estate outcomes depend on factors outside our control, including property condition, title, liens, occupancy, market conditions, financing, inspections, appraisals, governmental requirements, lender decisions, buyer performance, and the accuracy of information received.
We do not guarantee:
That an offer will be made or accepted.
A particular property value, sale price, or net proceeds.
That a property will sell or close.
A closing within any particular number of days.
That a lender, court, trustee, lienholder, or governmental agency will take or refrain from taking any action.
That a listing will produce a particular result.
That information on the Site is complete, current, or applicable to every situation.
References to possible closing times, cash offers, savings, proceeds, or other outcomes are examples only and remain subject to verification, negotiation, written agreements, title review, and transaction conditions.
7. Property Information and User Submissions
When you submit information, you represent that:
The information is accurate to the best of your knowledge.
You have the authority to provide it.
You are the property owner, an authorized representative, or otherwise permitted to discuss the property.
Your submission does not violate another person’s privacy, contractual, intellectual-property, or legal rights.
Information you submit may include your contact details, property address, ownership information, property condition, mortgage or lien estimates, desired timeline, occupancy information, and facts relevant to evaluating possible options.
Do not submit Social Security numbers, complete bank-account numbers, account passwords, access codes, medical records, copies of identity documents, or other highly sensitive information through a general website form unless we specifically request it through an appropriate secure method.
You grant Pipeline Homes a limited, nonexclusive right to use the information you submit for the purpose of responding to you, evaluating the property or request, providing services, maintaining records, and conducting activities described in our Privacy Policy.
8. Communications
By submitting a form, requesting a consultation or guide, calling us, emailing us, or otherwise asking us to respond, you authorize Pipeline Homes and its representatives to contact you regarding your request using the contact information you provide.
Contacts may include telephone calls, person-to-person text messages, and emails reasonably related to your inquiry, property, requested information, appointment, or potential transaction.
Where you separately provide legally sufficient marketing consent, you may also receive marketing calls or text messages, including communications sent using automated technology or an artificial or prerecorded voice where permitted by law.
Consent to receive automated or marketing communications is not a condition of receiving an offer, purchasing services, or entering into a transaction.
Message frequency may vary. Message and data rates may apply.
You may:
Reply STOP to opt out of marketing text messages.
Use an unsubscribe link to opt out of marketing emails.
Tell us during a call that you do not want additional marketing calls.
Contact us using the information below to withdraw consent.
An opt-out request may not prevent communications that are necessary to complete an existing transaction, respond to a pending request, provide legally required notices, or address safety, fraud, or security matters.
You agree that you are the subscriber or customary user of any telephone number you provide and will notify us if that number changes.
9. Electronic Communications and Signatures
You consent to receive disclosures and communications electronically when permitted by law.
Typing your name, checking an electronic box, clicking an acceptance button, or using another electronic-signature process may constitute your electronic signature when the surrounding language clearly indicates that effect.
Website submissions alone do not create a binding real estate purchase, listing, brokerage, or other transaction agreement. Such agreements require appropriate separate documentation.
10. Intellectual Property
The Site and its content—including text, guides, graphics, logos, photographs, videos, layouts, branding, downloads, and software—are owned by or licensed to Pipeline Homes and are protected by applicable intellectual-property laws.
Pipeline Homes grants you a limited, revocable, nonexclusive, nontransferable license to access the Site and download materials made available for your personal, noncommercial use.
You may not remove copyright or trademark notices, reproduce materials for commercial distribution, create derivative works, or use Pipeline Homes branding without prior written permission.
“REALTOR®” and related marks are membership marks belonging to the National Association of REALTORS® and may be used only in accordance with applicable rules.
11. Third-Party Services and Links
The Site may use or link to third-party services, including scheduling platforms, maps, social-media sites, video platforms, customer-relationship-management systems, email and text providers, analytics providers, advertising platforms, title or escrow providers, lenders, contractors, and other real estate professionals.
Pipeline Homes does not control every third-party site or service and is not responsible for its availability, content, security, privacy practices, representations, or performance.
A link or referral does not necessarily constitute an endorsement or guarantee. Your dealings with a third party may be governed by separate terms and privacy policies.
12. Fair Housing and Nondiscrimination
Pipeline Homes supports equal housing opportunity and conducts its activities in accordance with applicable fair housing and nondiscrimination laws.
We do not make housing-service decisions based on race, color, religion, sex, disability, familial status, national origin, or any other classification protected by applicable law.
13. Website Availability and Changes
We may modify, suspend, discontinue, or restrict all or part of the Site at any time. We do not guarantee that the Site will always be uninterrupted, secure, complete, or error-free.
Information may become outdated, and we have no obligation to update every prior statement or publication.
14. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
PIPELINE HOMES DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES RELATING TO THE SITE, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, SECURITY, AND AVAILABILITY.
Nothing in this section excludes a warranty or right that cannot lawfully be excluded.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PIPELINE HOMES AND ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AFFILIATES, BROKERS, AGENTS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM USE OF OR INABILITY TO USE THE SITE.
This includes lost profits, lost opportunities, loss of data, missed deadlines, loss of property value, foreclosure consequences, or reliance on general Site information.
To the maximum extent permitted by law, aggregate liability arising solely from your use of the Site will not exceed the greater of $100 or the amount you paid Pipeline Homes specifically for use of the Site during the preceding 12 months.
These limitations do not alter obligations or liabilities established in a separately signed real estate, brokerage, purchase, or other transaction agreement and do not apply where prohibited by law.
16. Indemnification
To the extent permitted by law, you agree to indemnify and hold Pipeline Homes and its members, employees, representatives, affiliates, brokers, contractors, and service providers harmless from claims, liabilities, losses, damages, and reasonable expenses arising from:
Your unlawful or unauthorized use of the Site.
Information you submit without authority.
Your material violation of these Terms.
Your infringement of another person’s rights.
This provision does not require you to indemnify any person for that person’s own fraud, willful misconduct, or liability that cannot lawfully be shifted.
17. Governing Law and Disputes
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles.
Before filing a lawsuit concerning the Site, the parties agree to make a good-faith effort to resolve the dispute informally by providing written notice describing the issue and requested resolution. The receiving party will have 30 days to respond.
Unless applicable law requires otherwise, any lawsuit arising solely from these Terms or use of the Site must be brought in a state or federal court located in Maricopa County, Arizona, and each party consents to jurisdiction and venue there.
This section does not prevent either party from pursuing an eligible matter in small-claims court or seeking emergency injunctive relief.
Separate transaction agreements may contain different dispute-resolution provisions, which will control disputes governed by those agreements.
18. Changes to These Terms
We may update these Terms periodically. The revised version will be posted with a new “Last Updated” date.
Changes apply prospectively when posted unless another effective date is stated. Your continued use of the Site after an update constitutes acceptance of the revised Terms.
Material changes affecting previously collected personal information will also be handled in accordance with our Privacy Policy and applicable law.
19. Severability and Waiver
If a provision of these Terms is determined to be unlawful or unenforceable, it will be enforced to the maximum lawful extent, and the remaining provisions will remain effective.
Failure to enforce a provision does not waive the right to enforce it later.
20. Entire Agreement
These Terms and the Privacy Policy constitute the agreement governing use of the Site.
They do not replace or modify a signed purchase contract, listing agreement, real estate employment agreement, agency disclosure, referral agreement, escrow instruction, or other transaction document.
If these Terms conflict with a separately signed agreement concerning a specific transaction, the separately signed agreement controls that transaction.
